PRIVACY STATEMENT BETWEEN USER AND KUHNSOFT, LLC (DBA SOHUNGRY / SOHUNGRY.NET)

KUHNSOFT, LLC (DBA SOHUNGRY / SOHUNGRY.NET) is committed to protecting your privacy and developing technology
that gives you the most powerful and safe online experience. This Statement of Privacy
applies to the SoHungry site and governs data collection and usage.
By using the SoHungry site, you consent to the data practices described
in this statement.
COLLECTION OF YOUR PERSONAL INFORMATION
For consumers ordering food, SoHungry collects (in the category of personal information), personally identifiable information as follows: name, email
address, home or work address (for delivery orders only), and telephone number (to alert you when food is ready for pickup/delivery, or to call you in case there is an issue with your order)
This information is to make the food ordering system work properly and so we can identify you for your food order. We also temporarily collect, but do not save, your geocoordinates (latitude/longitude) so we can
find businesses that are closest to you.
For restaurants/caterers, we collect all of the above information from you as well as collect and save your geocoordinates and address in our database so we can identify consumers that are closest to you and so they can place their orders with you.
For restaurants/caterers, providing your Mobile Phone number, allows us to notify you of new orders as well as give you assistance with your setup and technical support of the system via Txt Msg or phone calls to you. We are not responsible for any SMS Txt Msg rates you may incur from a carrier.
For customers, consumers ordering from restaurants & caterers, by providing your Mobile Phone number, you are opting in so that we can notify you whenever your food is ready for pickup (or delivery). By providing your Email Address, you agree to allow SoHungry to email you an invoice of your current order as well as are opting in to email marketing so that we may email you about other businesses or offerings in your area related to the SoHungry platform.
There is also information about your computer hardware and software that is automatically
collected by SoHungry. This information can include: your IP address,
browser type, domain names, access times, referring website addresses, as well as location data so we can find and locate food properly. This
information is used by SoHungry for the operation of the service, to
maintain quality of the service, and to provide general statistics regarding use
of the SoHungry site. Our apps in the app stores (coming soon) will prompt for location access but will not collect background location data. We use location information to either find food nearby if you are a consumer as well as to pinpoint the location of your food service if you are a restaurant or caterer.
Please keep in mind that if you directly disclose personally identifiable information
or personally sensitive data through SoHungry,
this information may be collected and used by others.
You may notify us at any time to have your information purged from our system by sending us an email with your request to support@sohungry.net.
Or, call us at +1 (412) 748-1025. Registered restaurants can also click on their User Profile and click the Close Account button to have their account deactivated and data purged.
Consumers in the state of California may request access to review, delete, or restrict the processing of their personal identifieable information collected through the app using the above-mentioned contact information.
Consumers who are minors, if we know they are minors, will have their information obfuscated/encrypted so that we only know an order was placed at a period of time and to a specific business, but that no personal identifiable information can be extracted of that minor. If you are a minor or are parent or guardian of a minor that you know uses SoHungry, you may request deletion and/or obfuscation of the minor's information at any time also using the previously mentioned contact information above.
This information is the only information we collect so that the food provider can identify your order and know that it belongs to you as well as can contact you in case there is a question or problem with your order. For minors under age 16, or anyone else for that matter, we do not collect any additional information other than this bare minimum needed in case the business needs to contact you about your order.
By default, the above information is kept for a period of up to 3 years for accounting purposes by food businesses and for their bookkeeping and tax purposes.
SoHungry encourages you to review the privacy statements of Web sites
you choose to link to from SoHungry so that you can understand how those
Web sites collect, use and share your information. SoHungry is not responsible
for the privacy statements or other content on Web sites outside of the SoHungry
and SoHungry family of Web sites.
USE OF YOUR PERSONAL INFORMATION
SoHungry collects and uses your personal information to operate the SoHungry
Web site and deliver the services you have requested. SoHungry also uses
your personally identifiable information to inform you of other products or services
available from SoHungry and its affiliates. SoHungry may also
contact you via surveys to conduct research about your opinion of current services
or of potential new services that may be offered.
SoHungry does not sell, rent or lease your 'customers' or 'customer lists' to third parties.
SoHungry may, from time to time, contact you on behalf of external business
partners about a particular offering that may be of interest to you and communicate with you about
value added offerings. In addition, SoHungry
may share data with trusted partners to help integrate with value-add services to
provide additional functionality and benefit to restaurants/caterers using our platform such as selecting a payment provider to use with SoHungry or mapping services to make you more visible when your food business is active.
You may choose not to use these other like/similar services and may email us to have
your data removed from these other services if you choose not to use them or they do
not benefit you. We may also share data to help us perform statistical analysis, send
you email or postal mail, provide customer support, or arrange for deliveries. All
such third parties are prohibited from using your personal information except to
provide these services to SoHungry, and they are required to maintain
the confidentiality of your information.
SoHungry does not use or disclose sensitive personal information, such
as race, religion, or political affiliations, without your explicit consent.
SoHungry keeps track of the Web sites and pages our customers visit within
SoHungry, in order to determine what SoHungry services are
the most popular. This data is used to deliver customized content and advertising
within SoHungry to customers whose behavior indicates that they are interested
in a particular subject area.
We send periodic updates via email (newsletters) as well as order notification emails (invoices).
You may unsubscribe to newsletters at any time using the Unsubscribe link provided within our periodic newsletters
which often also contain important system updates and enhancements. However, we have the right to always email you related to information about your account as well as copy you on things related to the usage of this platform such as order invoices as your customers place orders.
SoHungry Web sites will disclose your personal information, without notice,
only if required to do so by law or in the good faith belief that such action is
necessary to: (a) conform to the edicts of the law or comply with legal process
served on SoHungry or the site; (b) protect and defend the rights or
property of SoHungry; and, (c) act under exigent circumstances to protect
the personal safety of users of SoHungry, or the public.
USE OF COOKIES
The SoHungry Web site use "cookies" to help you personalize your online
experience. A cookie is a text file that is placed on your hard disk by a Web page
server. Cookies cannot be used to run programs or deliver viruses to your computer.
Cookies are uniquely assigned to you, and can only be read by a web server in the
domain that issued the cookie to you.

register with SoHungry site or services, a cookie helps SoHungry

you previously provided can be retrieved, so you can easily use the SoHungry
features that you customized.

if you prefer. If you choose to decline cookies, you may not be able to fully experience
the interactive features of the SoHungry services or Web sites you visit.
SECURITY OF YOUR PERSONAL INFORMATION
SoHungry secures your personal information from unauthorized access,
use or disclosure. SoHungry secures the personally identifiable information
you provide on computer servers in a controlled, secure environment, protected from
unauthorized access, use or disclosure. When personal information (such as a credit
card number) is transmitted to other Web sites, it is protected through the use
of encryption, such as the Secure Socket Layer (SSL) protocol. SoHungry does not house or store sensitive information such as credit card details. These are transmitted real-time and are directly processed by a business's selected payment provider such as Square, Clover (Clover coming soon), or PayPal. This sensitive data never gets stored on SoHungry servers or databases and only refernces to your payment such as a Payment ID are stored in our platform.

SoHungry will occasionally update this Statement of Privacy to reflect
company and customer feedback. SoHungry encourages you to periodically
review this Statement to be informed of how SoHungry is protecting your
information.
